Alabama Personal Injury Lawsuit

Statute of Limitations

Like all other states, Alabama has a law known as the "statute of limitations" which places a set time limit on personal injury lawsuits. Under Alabama Code Section 6-2-38, you have two years from the date of your accident to file a personal injury lawsuit against the responsible party. If you do not file a claim by this deadline, you will lose your right to pursue compensation.

This deadline is even shorter for injury claims against government entities. In Alabama, a formal claim against a municipality must be filed within six months while a claim against a county must be filed within one year. Contributory Negligence in Alabama

It is important to know that Alabama is one of the few states which still follows the "contributory negligence" doctrine and requires defendants in law suits to be found 100% at fault in order to be held liable for any injuries caused to another party.
